A conservative legal group is accusing the Biden administration of directing the Internal Revenue Service to audit more white and Asian Americans in an effort to boost ‘equity.’
The America First Legal Foundation, a nonprofit that seeks to fight executive overreach, filed a Freedom of Information Act request on Tuesday claiming that an executive order President Biden signed last week encourages the IRS to alter its algorithms to audit more white and Asian taxpayers—and fewer black taxpayers.
Though the Executive Order on Further Advancing Racial Equity and Support for Underserved Communities Through The Federal Government does not specifically mention audits, it directs federal agencies—including the IRS—to find ways to make their practices more ‘equitable’ to underserved communities.
Specifically, the order directs agencies to ‘prevent and remedy discrimination, including by protecting the public from algorithmic discrimination.’
America First Legal Foundation is now investigating how that could affect the IRS, seeking internal documents from the agency referring to its efforts to improve ‘equity’ amongst Americans.
Under federal law, the Treasury Department now has just 20 business days to respond to the request.

Now, the America First Legal Foundation argues that Biden’s new directive could encourage the IRS to change that algorithm to underemphasize black households and businesses—and overemphasize white, Asian and mixed-race homes and businesses instead.
The organization cites other actions taken by the Biden administration, saying that since the president took office, the Treasury Department has been using ‘racial equity’ as a ‘key factor in the design of tax compliance’ and illegally ‘examining the tax system through a racial equity lens.’
It says: ‘Statements by Deputy Secretary of Treasury Wally Adeyemo, Assistant Secretary for Tax Policy Lily Batchelder and members of the Treasury Advisory Committee on Racial Equity demonstrate that the Treasury Department is committed to imputing race and ethnicity into tax data for the purpose of ensuing that more white, Asian and mixed-race Americans are audited based solely on their race or national origin.’
‘Consequently, there is very strong reason to believe that the Treasury Department is altering the IRS audit algorithms to illegally operationalize racial quotas and/or requiring agents to use imputed race and ethnicity data to ensure “racial equity.'”
As part of its FOIA request, the America First Legal Foundation is seeking all records and communication from specific individuals at the Treasury Department and the IRS ‘referring to “discrimination,” “discriminatory,” “race,” “racial,” “ethnicity,” “color,” “BIPOC,” “Asian,” “Indigenous,” “Black,” “Brown” or “white.”‘
It is also asking for documents mentioning ‘”audit,” “enforcement,” “NRP,” “RAAS,” “algorithmic,” “selection,” “sampling,” or “strata.”‘
America First is specifically asking for records of communication from January 20, 2021 through the time the FOIA request is processed, including communications from Treasury Secretary Janet Yellen.
In a statement, Gene Hamilton, the group’s vice president and general counsel, said: ‘The notion that race should play any role whatsoever in the IRS operations is absurd, offensive to the American ideal and illegal.
‘But the Biden administration is so blinded by its relentless obsession with race that it is wiling to make IRS enforcement decisions based on the race of American citizens.’
Stephen Miller, the president of the group, also said: ‘We will not allow the machinery of the federal government, with all its considerable and awesome powers, to be used to categorize and punish Americans based on skin color or to replace our entire constitutional order with race-and-gender based Marxism.’
The Democrat Party is now animated and powered by anti-whiteness. The Republican Party elite and donor base is terrified of being called racist, thus our nation is sacrificed to the anti-white concepts of Diversity, Equity, and Inclusion.
The America First Legal Foundation fight is the one capable of inspiring millions of white Americans who no longer have faith in the Republican Party representing their interests, and finally confronting the grotesque anti-whiteness advocated by increasingly non-white Democrat Party.
