Judge Andrew Hanen has again declared the Deferred Action For Childhood Arrivals (DACA) program illegal. The second ruling was necessitated by the Biden Regime’s rewriting the program with no changes in how it was administered and in the benefits provided to illegal aliens.

A U.S. judge on Wednesday ruled against a program offering deportation relief and work permits to immigrants brought to the country illegally as children, known as “Dreamers,” even after an attempt by President Joe Biden’s administration to bolster the program’s standing with a new regulation.

The decision by Texas-based U.S. District Court Judge Andrew Hanen deals a fresh setback to the program, called Deferred Action for Childhood Arrivals (DACA), and its 579,000 enrollees and other immigrants who might have hoped to enroll in the future.

Hanen, a Republican-appointed judge, found a regulation issued last year by Biden’s Democratic administration did not remedy legal deficiencies that led him to find DACA unlawful in 2021 and blocked new enrollments to the program, which has been in place for more than a decade.

But yet again, Judge Hanen’s courage and adherence to the Constitution failed him. He has only prohibited the enrollment of new applicants. What sense does that make? If the program is illegal, then it should be ended.

The U.S. Department of Homeland Security can continue to renew the status of those enrolled in the program prior to Hanen’s 2021 ruling, he said. Many DACA recipients speak English and have jobs, homes and families in the United States.

Hanen wrote that the order did not require U.S. immigration authorities “to take any immigration, deportation, or criminal action against any DACA recipient, applicant or any other individual that would otherwise not be taken.”

Well, we can see why. Even in the reporting—you see the implied threats from the Lügenpresse—many DACA illegals speak English and have family in the United States, as if many other illegal aliens don’t speak English and have family in the United States.

Instead of waffling, Judge Hanen should have ordered the program ended, as well as all work permits and Social Security Cards seized. Allowing illegal aliens to renew their work permits every two years in reality means the program can continue. It gives lie to the conclusion that the program is illegal. It cannot be illegal if beneficiaries of the program can renew their work permits indefinitely. This despite the fact that DACA recipients were and remain illegal aliens.

The real question: Will Kevin McCarthy cave and pass legislation protecting DACA illegal aliens?
